GDPR - No tick-box to compliance

The much anticipated General Data Protection Regulations (GDPR) came into effect on 25 May 2018.

Although lawyers are perhaps ahead of the game compared to other sectors because of the overriding obligations of client confidentiality, what is clear is that there is no ‘one size fits all’ approach for firms which will result in compliance. The Law Society's guide, Preparing for the GDPR: A guide for law firms is aimed at supporting firms with compliance. In their Spring 2018 Risk Outlook the SRA confirmed that where firms do not take reasonable steps to protect information they will take action. In December 2017, the SDT fined a solicitor £20,000 for practice management failures that included failures to dispose of client files in a secure manner.
