Dreamvar: What next?

The recent Court of Appeal judgment in the combined appeals in P&P v Owen White, Catlin and Another and Dreamvar v Mishcon de Reya and Another is culmination in the latest in a series of decisions involving breach of trust and breach of warranty in respect of losses resulting from identity fraud.

DWF were instructed on behalf of Mischon de Reya in the combined appeal. The Court of Appeal's landmark judgment leaves various questions unanswered and is unlikely to end the debate as to who is liable for losses in a property / identity fraud case of this nature.
