Insurance: Misrepresentation and non-disclosure - FOS online technical resource
The Financial Ombudsman Service (FOS) has published a new online technical resource on how it approaches cases involving misrepresentation and non-disclosure by consumers when taking out insurance policies

In the resource, which includes case studies, the FOS explains that these cases usually arise after the insurer has rejected the consumer's claim (for example, because the consumer provided inaccurate information when taking the policy out) and avoids the policy (that is, treats it as though it had never existed by refunding all premiums paid). Cases also arise where the consumer is unhappy that the insurer wants to charge an additional premium to continue to provide cover after discovering a misrepresentation.
